PRO-ED, Inc. (“PRO-ED”) develops and publishes standardized tests, books, curricular and therapeutic materials, including online software (the “Products and Services”) used by schools, professionals, and caregivers to improve the education and quality of life for students, clients, as well as for family members and their caregivers. We have over 250 standardized assessments that require updating every 7 to 10 years. A major part of creating and updating these assessments involves administering paper and pencil and online tests along with collecting basic background data on individuals of varying ages, races, ethnicities, and ability levels.
The data we collect is used to establish “norms,” which are national averages by populations so that professional clinicians can use these measures to determine if a given individual has a disability and to determine the severity of that disability. While our tests are used primarily with persons suspected of having some sort of educational disability, the test examinees we need and the data we collect is typically from persons not diagnosed with a disability. However, for some of our tests related to specific conditions, we need test examinees that have been diagnosed with certain conditions to validate our tests. As a result, we request demographic and disability/exceptionality information from potential examinees.
This agreement (the “Agreement”) between you (the “Examinee”) and PRO-ED, Inc. (“PRO-ED”) is entered into upon your acceptance by checking the “Accept” button below (the “Effective Date”). In consideration of Examinee participating in the PRO-ED Examinee Portal and PRO-ED providing the PRO-ED Examinee Portal, the Parties hereby agree as follows:
PRO-ED EXAMINEE PORTAL
Purpose: PRO-ED has developed the online web-based PRO-ED examinee portal (the “PRO-ED Examinee Portal” or “Portal”) to match individuals who have volunteered to participate in the Portal and provide their information to PRO-ED for the purposes of being matched with authorized professionals (“Field Examiner(s)”) who administer PRO-ED tests, assessments, and evaluations that PRO-ED owns or has the rights to use (the “Test(s)”) for field testing purposes of better ensuring test quality and validity, and for PRO-ED’s research and product development efforts.
Participation: Anyone who resides in the United States or its territories can join the PRO-ED Examinee Portal. If you decide to join, you will be asked if you are registering for yourself or someone else when you start the Examinee Registration Form. A parent, legal guardian, or caretaker is legally allowed register a child under the age of 18 and they must certify that they are the legal representative of that person. There is no cost to participate in the PRO-ED Examinee Portal or in an eligible field Test administration.
Registration: To register and participate in the PRO-ED Examinee Portal and field testings where you are eligible, you must do the following: a. agree and accept this Examinee Participation Agreement; b. complete the Examinee Registration Form and provide identifying information including your first name, last name, data of birth, email address, city, state, zip code, gender, race, Spanish/Hispanic/Latino status, current Grade or highest level of education obtained, and a username and password to create an your account profile, (the “Personal Information”); and c. agree to our Terms of Use for the Examinee Portal, including an acknowledgement that you have read and understand our Privacy Policy. On the Examinee Registration Form you do not have to answer all questions about your conditions or provide other requested background information except for those fields with an asterisk that are required. Only the information that you choose to enter will be included in your account profile. The Personal Information you provide will be stored securely and will be kept confidential as described below and in the PRO-ED Examinee Portal Privacy Policy. Testing time varies from as little as 20 minutes to as much as 2 hours and is generally compensated at a rate of between $30-$150 per test that is administered, depending on how long the particular test takes to administer. The data and test examinees we need for any given test and at any given time may be very particular with regard to disability, age, race, language spoken, or ethnicity. This helps us build a data sample that is representative of the public at large and helps us eliminate racial or ethnic bias in our tests.
Examinee Account and Profile: To complete the registration process, you are required to create an account profile by entering a unique username and password. We confirm/verify your registration by sending you an email confirmation after you submit the Examinee Registration Form to us. A unique username is required for each Examinee. Once you are accepted and registered, we will set up your account including your “profile” that contains your contact, conditions and demographic information. You can edit your profile at any time by accessing your account. You can also delete your profile and account from the PRO-ED Examinee Portal by accessing your account profile and clicking on “Delete Account”; if for some reason you cannot access your account, you can contact privacy@proedinc.com or call 800-897-3202 and we can assist. When you register, you will create a unique username and password that will give you access to your Examinee profile. Do not share your username and password with anyone (except legal guardian/parent). You can change your username, password, Personal Information and other details in your account at any time by accessing your account. Contact PRO-ED immediately if you think someone else has used your username and password or if you have any other security concerns.
How it Works: We take data privacy seriously and thus no one who is tested is identified individually within the PRO-ED Examinee Portal or Test database. Instead, Examinees are assigned a random number for identification purposes to ensure that they cannot be identified. Once you join the PRO-ED Examinee Portal your non-identifiable information (e.g. age, zip code, race/ethnicity, condition) becomes part of an aggregated pool of anonymous prospective test taker data. Authorized Field Examiners search through this pool when looking for people to contact about PRO-ED field Test administrations. PRO-ED indicates to Field Examiners for each Test when an administration is needed and the types of Examinees needed (factors such as age, condition, location). PRO-ED retains your Registration Form and Test Authorization form for purposes of validating examinees, to maintain test security and integrity, and as described in our PRO-ED Examinee Portal Privacy Policy.
Agreeing to Field Tests: Examinees can see in their account certain PRO-ED field Test administrations for which they are eligible based on their profile information. You can check the Test administration(s) in which you are interested and agree to allow authorized Field Examiner(s) to contact you about the Test(s). Field Examiners (either PRO-ED employees or qualified professionals that are contractors of PRO-ED) receive your name, email, date of birth, disability/exceptionality information (as applicable) that they need to contact you and provide information about scheduling the Test. For any in person testing, you will be required to sign a COVID release agreement. When you complete the Examinee Registration Form you are asked to agree at that time.
PRO-ED may perform quality and evaluation metrics on the PRO-ED Examinee Portal on an on-going basis. Part of that process may involve collecting non-identifiable information about your contact and enrollment status in Test administrations such as your IP address and other device information. This will help us see how useful this tool is to PRO-ED and Field Examiners. We also use this information and your Personal Information only as applicable for security and fraud prevention to ensure that each Examinee is a unique individual, prevent fraud and to protect the integrity of our Tests, products and services and the PRO-ED Examinee Portal.
Compensation: If you complete the registration process and agree to participate in a Test administration and complete the Test, you may receive compensation from the Field Examiner that is administering the Test; for online administrations, PRO-ED will provide compensation in the form of an e-gift card for Examinees that complete the Test. The amount of the compensation varies depending on the Test that is administered. PRO-ED cannot guarantee that you will be selected for any Test administration and thus cannot guarantee any compensation will be provided. Generally, after completion the Examinee is provided with a code to validate an e-gift card and the amount of compensation will be specified by the Field Administrator if you are selected for a field Test administration. PRO-ED Examinee Portal Disclaimer: PRO-ED does not promise that Test Examiners will contact you about any Test administrations through the Examinee Portal system and as such no compensation can be guaranteed.
Privacy and Protection of Information: PRO-ED respects your privacy and we want you to understand our privacy practices. Your Personal Information will be kept confidential and secure. Please see the PRO-ED Examinee Portal Privacy Policy for more details. PRO-ED does not sell, rent, or lease your Personal Information that you have provided for the Examinee Portal. However, you understand that PRO-ED receives remuneration for its products and services, including its Tests, as part of its business. As described above, PRO-ED will provide Field Examiners with your contact information, date of birth, race and disability/exceptionality information as applicable to allow them to contact you about a specified field Test that you agreed to participate in from your account.
If you participate in a field Test(s), you will be required to accept the Test Authorization agreement where you must provide your name, date of birth and phone number. This information is requested in the event PRO-ED needs to audit a Test administration and confirm that individual examinees completed the respective test. For paper field Test administration, Field Examiners may request demographic information from you but this information is deidentified so you are not individually identifiable.
Terms of Use: Your participation in the PRO-ED Examinee Portal is governed by the PRO-ED Examinee Portal Terms of Use and you will be asked to agree to these Terms in order to register on the PRO-ED Examinee Portal. Please read these Terms of Use.
Withdraw from Portal: If you decide that you no longer wish to participate in the PRO-ED Examinee Portal, you can access your account and click on “Delete Account.” By doing this, your account and your profile, including your Personal Information will be deleted. You understand that your information that was used in previous field Test administrations may be retained for test administration and in compliance with our retention policies.
No Health Care Services or Treatment Provided: PRO-ED is not providing any health or medical services and is not subject to the U.S. Health Insurance and Portability Accountability Act (“HIPAA”) related to its PRO-ED Examinee Portal and your participation in the Examinee Portal, any field Test administrations, or in any related research and product development.

By agreeing to this Examinee Participant Agreement you agree to the above and to permit PRO-ED, Inc. its affiliates and authorized contractors to collect, use, store and share your Personal Information including any sensitive personal information including disability, exceptionality, race and ethnicity provided on the Examinee Registration Form and on the PRO-ED Examinee Portal profile as described herein and in the PRO-ED Examinee Portal Privacy Policy.
By finishing the registration process, you represent and warrant that you live in the United States or its territories, are at least eighteen years of age, and that you possess the legal right and ability to enter into this Examinee Participation Agreement. If you register someone who may not be able to register themselves (including individuals under the age of 18, or someone who is unable to register without your assistance), you certify that you are their legal guardian, parent or caretaker and agree to the terms outlined in this agreement. You agree that if you register on the PRO-ED Examinee Portal, you will give accurate information about yourself. You agree that if any information you provide is inaccurate, PRO-ED may restrict you from accessing the PRO-ED Examinee Portal.
